The Construction (Design and Management) Regulations 1994
It is important to be aware that on certain pallet racking installations CDM regs do apply, particularly when building construction is involved. CDM Regulations place duties on the client and others for whom the client is responsible – for example the planning supervisor,
the designer and contractors – to plan, co-ordinate and manage health and safety issues throughout all stages of a construction project. Anyone who appoints a designer or contractor has to ensure that they are competent for that work and will allocate
adequate resources to health and safety.
The CDM regulations apply to construction work that is notifiable, for example:
– work which lasts for more than 30 days
– work which involves more than 500 ‘person days’; or involves 5 or more persons on site
– work which involves design work, of any duration
-work which involves any demolition
The responsibilities of the client as a ‘Duty Holder’ under CDM regulations include:
– the appointment of a planning supervisor
– providing health and safety information to the planning supervisor
– the appointment of a principal contractor
– the appointment of a designer
– ensuring that the Duty Holders have adequate resources to meet their responsibilities
– ensuring that the principal contractor prepares a health and safety plan before construction work commences
– ensuring continued maintenance of the safety file during all stages of the project work.
– presentation of the safety file to the end user.
The CDM Regulations are part of the Health & Safety at Work Act and as such come under the auspices of the Health and Safety Executive.
In order to comply with these regulations, it is the duty of the client to appoint a planning supervisor and a principal contractor, to generate a suitable safety plan and to advise the HSE of the project.
All reputable suppliers of Pallet Racking will comply fully with CDM regulations in the role of contractor.
